PROMOTION OF GENDER EQUITY IN PUBLIC CONTRACTING IN MARANHÃO: AN ANALYSIS THROUGH THE CAPABILITIES APPROACH

The promotion of gender equity in public contracting emerges as a fundamental strategy to address historical inequalities and drive the socioeconomic inclusion of women, including cisgender, transgender, and transvestites, especially those in situations of social vulnerability. In Maranhão, innovative normative initiatives place the state in a prominent national position, by establishing specific mechanisms for this inclusion. This study aimed to critically analyze the existing legal frameworks at both the federal and state levels in Maranhão, evaluate the social function of companies in public contracting, and verify the alignment of these practices with the Sustainable Development Goals proposed by the United Nations, emphasizing the goals related to gender equality, decent work, and the reduction of inequalities. The methodology is qualitative and analytical, combining bibliographic review, normative analysis, and statistical contextualization, and it adopts Martha Nussbaum's capabilities approach as its evaluative framework. Thus, it is concluded that the initiatives in Maranhão rest on a consistent legal foundation, although their capacity to expand freedoms depends on implementation and oversight, such as monitoring compliance with quotas and the need for a cultural shift in the corporate environment.
