THE IMPLEMENTATION OF ARTIFICIAL INTELLIGENCE IN THE DIGITAL TRANSFORMATION OF THE STATE: A FOCUS ON REGULATORY IMPROVEMENT

Digital transformation has become a central pillar in the modernization of governments, serving as a strategic means to enhance efficiency, transparency, and accessibility in public services. Within this context, artificial intelligence (AI) stands out as a transformative tool capable of reshaping traditional administrative processes and enabling States to respond more effectively and promptly to societal demands. The growing connection between digital transformation and regulatory improvement highlights the potential of AI to strengthen regulatory quality and effectiveness. Regulatory improvement, understood as the set of policies and instruments aimed at optimizing the design, implementation, and evaluation of regulations, can significantly benefit from the analytical, predictive, and automation capabilities offered by AI technologies. Through advanced data analysis and pattern recognition, AI can assist governments in identifying regulatory redundancies, anticipating regulatory impacts, improving evidence-based decision-making, and facilitating regulatory compliance for citizens and businesses. This chapter develops a comprehensive analytical framework to examine the role of AI in advancing regulatory improvement within the public sector. The theoretical approach is structured around three main axes: the contribution of AI to administrative efficiency and regulatory quality; the technical and functional dimensions of AI applied to regulatory processes; and governance and ethical challenges, with particular emphasis on transparency, inclusion, accountability, and responsible use of AI in public administration.
